Maritime Asset Ownership and Liquidation Disputes for Amigos and Kemet

Advising and representing Amigos Stevedoring and Kemet Stevedoring (KMT) in a complex commercial and port dispute concerning operating equipment and marine units with a total estimated value of around EGP 23 million, which had been included in the liquidation estate of another company despite the clients’ claim to independent ownership of them.

El Roby Law Firm rebuilt the legal position of each asset individually, reviewing the sale contracts, customs documents, registration certificates, operating licences, and partition and exit agreements, and reconciling the technical and registration data of the assets with the liquidator’s reports and the auction proceedings.

The firm also resisted attempts to restrict the movement of the equipment within the Port of Alexandria ahead of offering it for sale at auction, insisting on the limits of the liquidator’s authority and on the principle that a liquidation estate does not extend to assets owned by independent legal entities. It pursued parallel judicial and enforcement proceedings, including an application to remove the liquidator, claims to exclude the assets from the liquidation estate, and the related enforcement disputes, while dealing with the port and regulatory authorities to preserve the operating position of the assets and their licences.

The proceedings resulted in the removal of the court-appointed liquidator and the end of his authority to continue the contested liquidation proceedings, together with the renewal of the operating licences for Amigos’s equipment and the preservation of its continued use. The ownership and asset-exclusion claims, including those concerning the assets owned by KMT, remain pending before the Court of Appeal.

The matter highlights the firm’s experience in maritime and port disputes and in liquidation and enforcement disputes, particularly in cases that require combining the protection of ownership, court proceedings, oversight of liquidation proceedings, and the continuity of operations.
